Introduction

Welcome to UptimePlus by WL-STD ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the UptimePlus website, applications, and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and WL-STD regarding your use of the Service. Please read them carefully before using UptimePlus.

Account Registration

To use certain features of the Service, you may be required to register for an account. When registering, you agree to provide accurate, current, and complete information about yourself.

Account Security

You are responsible for maintaining the confidentiality of your account credentials.
You are solely responsible for all activities that occur under your account.
You must immediately notify us of any unauthorized use of your account or any other breach of security.

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

Acceptable Use

When using our Service, you agree to comply with the following acceptable use guidelines:

Prohibited Uses

You agree not to use the Service to monitor, check, or otherwise interact with:

Spam websites: Sites that distribute unsolicited bulk messages or engage in deceptive marketing practices.
Adult content: Sites containing pornographic, sexually explicit, or age-restricted content.
Illegal content: Sites engaged in illegal activities or distributing illegal content.
Malicious content: Sites distributing malware, viruses, or other harmful code.

Fair Usage Policy

To ensure consistent service quality for all users, UptimePlus implements a fair usage policy:

The 1-minute monitoring feature must be used reasonably and for its intended purpose.
You agree not to create excessive load on our servers through unnecessary or automated requests.
You agree not to engage in any activity that disrupts or interferes with the Service, servers, or networks connected to the Service.

We reserve the right to limit or restrict access to certain features or functionality of the Service if we determine, in our sole discretion, that your usage creates an unreasonable load on our infrastructure.

Service Limitations and Modifications

We strive to provide uninterrupted service. However, we cannot guarantee that the Service will be available at all times. We may experience hardware, software, or other problems, or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

We reserve the right to:

Modify or discontinue, temporarily or permanently, the Service or any part thereof with or without notice.
Change the Service, features, functionality, or pricing at any time.
Impose limits on certain features and services or restrict access to parts or all of the Service without notice or liability.

We will not be liable for any modification, suspension, or discontinuance of the Service.

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of WL-STD and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of WL-STD.

User Content

Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting User Content on or through the Service, you represent and warrant that:

You own or have the necessary rights to use and authorize us to use all intellectual property and other rights in and to any User Content.
The User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

We reserve the right to remove any User Content from the Service at our discretion, without prior notice and without liability.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Violation of Terms

The following actions may result in account suspension or termination:

Monitoring spam, adult, or other prohibited websites
Abuse of the 1-minute monitoring feature
Creating excessive load on our servers
Any other violation of these Terms

We reserve the right to make the final determination of what constitutes a violation of these Terms and to take appropriate action, including immediate termination of your account without refund.

Limitation of Liability

In no event shall WL-STD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service; and
Unauthorized access, use or alteration of your transmissions or content.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

Service Assurances and Disclaimer

UptimePlus is committed to providing reliable uptime monitoring services. As part of our commitment to our users, we strive to:

Maintain a high level of service availability for our monitoring infrastructure
Provide accurate and timely notifications when your monitored services experience downtime
Deliver monitoring data according to the intervals specified in your subscription plan
Implement industry-standard security measures to protect your account and data

However, while we make these commitments, please note the following limitations:

The accuracy of our monitoring is dependent on various factors including but not limited to Internet routing, DNS resolution, and third-party services
Short-duration outages may not be detected depending on your selected monitoring interval
Notification delivery is dependent on third-party communication services (email providers, SMS gateways, etc.)
We cannot guarantee that all instances of downtime will be detected under all possible circumstances

For specific uptime guarantees and service level agreements, please refer to your subscription plan details. Different levels of service assurance apply to different subscription tiers.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which WL-STD is established, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
